Although the Court was satisfied that the applicant justified contravention of the building height development standard and that the concept proposal was consistent with the objectives of that standard and the R4 zone, consent was refused because the concept proposal did not achieve the objects of the DCP or RFDC. The proposed building separations, excessive building widths, orientation of buildings 3 to 6, reduced common open space and overshadowing impacts would unnecessarily constrain the ability of future development applications to provide satisfactory apartment amenity, and those deficiencies were inappropriate for a concept proposal that would bind later applications.
