The Supreme Court lacked jurisdiction to entertain the proceedings, as exclusive jurisdiction for the enforcement or review of rights and functions under planning or environmental laws is vested in the Land and Environment Court by s 71 and s 20 of the Land and Environment Court Act 1979 (NSW. Furthermore, the statutory scheme for powers of entry under s 196 of the Protection of the Environment Operations Act 1997 (NSW), as picked up by s 156B(2)(a) of the National Parks and Wildlife Act 1974 (NSW), clearly displaces any obligation to accord procedural fairness prior to exercise of entry powers.
