Procedural Posture

Professional Misconduct Proceedings / Final Decision on Finding and Consequential Orders

  1. 1 ["Whether the solicitor's deception of the Melbourne Cricket Club and use of a deceased member's membership card constituted professional misconduct." 'Whether the solicitor attempted to mislead a Melbourne Cricket Club official on 28 September 2013.' 'What orders should be made following a finding of professional misconduct.']

Ratio Decidendi

The solicitor intentionally deceived the Melbourne Cricket Club by pretending that deceased member Michael Starkey was alive, providing his own photograph and a forged signature for a membership card, impersonating Mr Starkey to attend Grand Finals, and attempting to mislead a club official when confronted. That conduct was disgraceful and dishonourable and amounted to professional misconduct. In light of the solicitor's age, ill health, retirement, lack of practising certificate, undertaking not to apply for one, previously unblemished career and references, community protection and deterrence were satisfied by a reprimand, fine and costs order rather than removal from the roll.

Court Disposition

Solicitor found guilty of professional misconduct; reprimanded; fined; ordered to pay the Legal Services Commissioner's costs as agreed or assessed.

Orders

  • ['That the Solicitor is guilty of professional misconduct.' 'That the Solicitor be reprimanded.' 'That the Solicitor pay a fine of $10,000.' 'That the Solicitor pay the costs of the Legal Services Commissioner as agreed upon or assessed.']
