Wilson v Britten-Jones [2019] FCA 747

Wilson v Britten-Jones [2019] FCA 747

The applicant failed to demonstrate a prima facie case that her expulsion—or the process to consider her expulsion—was taken on the ground of her sex or was otherwise unlawful under the Sex Discrimination Act. Nor did she establish a prima facie case of victimisation. Accordingly, the balance of convenience also weighed against the grant of interlocutory relief, and the injunction was discharged.

Procedural Posture

Interlocutory Application / Ruling on Interlocutory Injunction

  1. 1 Whether an interlocutory injunction should be granted restraining the respondents from convening a meeting to consider expelling the applicant from the partnership
  2. 2 Whether the applicant has demonstrated a prima facie case for relief based on breach of s 14(3) and s 94 of the Sex Discrimination Act 1984 (Cth)
  3. 3 Whether there is sufficient likelihood of success to justify interlocutory injunction under s 46PP of the AHRC Act

Ratio Decidendi

The applicant failed to demonstrate a prima facie case that her expulsion—or the process to consider her expulsion—was taken on the ground of her sex or was otherwise unlawful under the Sex Discrimination Act. Nor did she establish a prima facie case of victimisation. Accordingly, the balance of convenience also weighed against the grant of interlocutory relief, and the injunction was discharged.
