The request for prospective tape recording protocols was not fit for judicial resolution, the refusal to allow tape recording was not itself a reviewable ADJR decision and there was insufficient evidence to establish reviewable legal error in any conduct. The Court was satisfied that actions of Sarina Russo relevant to the applications were performed under valid delegations pursuant to the SSA Act.
