Procedural Posture

Appeal / High Court Appeal From Supreme Court of Queensland (following Court of Appeal Decision)

  1. 1 Whether contractual restraint for use of information continues after public disclosure
  2. 2 Whether the confidentiality agreement constitutes an unenforceable restraint of trade
  3. 3 Whether injunction was appropriate in scope and duration

Ratio Decidendi

The court held that the restraint in the confidentiality agreements, which purported to indefinitely prohibit use of information even after public disclosure by the appellants themselves, was subject to the doctrine of restraint of trade and, being unlimited and covering information no longer confidential, was invalid and unenforceable absent demonstration of reasonableness. The appeal was dismissed, upholding the setting aside of injunctive relief and limiting damages.
