Even though the offer of compromise was accepted within the stipulated period and service was sufficient as actual notice was given, the offer was made under a unilateral mistake by the plaintiff's solicitor as to the sum in issue. The defendant's solicitors neither knew nor should have known of that mistake, so contractual principles would not set aside the agreement. However, the court exercised its supervisory jurisdiction over its own procedures and declined to enforce the compromise, holding that enforcement would be unjust where the offer was made under such a mistake.
