Procedural Posture

Appeal in Intellectual Property Proceeding Concerning Trade Mark Infringement, Passing Off and Misleading and Deceptive Conduct / Appeal From Orders Dismissing Mars Australia's Proceeding With Costs

  1. 1 ["Whether Sweet Rewards' red Delfi Malt Balls packaging infringed Mars Australia's registered Maltesers trade marks" 'Whether Sweet Rewards passed off its Malt Balls product as Maltesers or otherwise as a Mars product' 'Whether the Sweet Rewards label conveyed misleading or deceptive representations of association, source, endorsement, product equivalence, ingredients, recipe or taste experience' 'Whether the primary judge erred by considering the fame of the Maltesers marks when assessing deceptive similarity']

Ratio Decidendi

The Full Court held that the distinguishing feature of the Maltesers get-up and trade marks was the word 'Maltesers'. The red colour, diagonal script style and depictions of whole and cut-through malt balls were commonplace in confectionery packaging, and 'Malt Balls' was descriptive of the Sweet Rewards product. Sweet Rewards did not use those features as a trade mark; the distinguishing feature of its product was the Delfi trade mark. Considered as a whole, the Sweet Rewards label was not deceptively similar to Mars' trade marks, did not pass off the goods as Maltesers or a Mars product, and did not make misleading or deceptive representations.
