R v PCB [2012] NSWSC 482

PCB was suffering from an acute exacerbation of his chronic schizophrenic illness at the time of the offences, leading to a defect of reason such that he did not know that his acts were wrong. The defence of mental illness was established on the balance of probabilities for each offence. As a consequence, verdicts of not guilty by reason of mental illness were returned and a detention order made under s.39 of the Mental Health (Forensic Provisions) Act 1990.
