Because the judge had previously made strong adverse findings about Mr Harradine's credit and a finding that Mr Gilmour demonstrated a lack of candour, and because their credit would be significant at trial on live factual issues, there was a real possibility that it might be perceived that the judge had pre-judged Mr Harradine's credit. The judge therefore recused himself from further hearing the matter.
