The trial judge erred in the weight given to the testator's wishes and in providing Kerryn with a disproportionately large legacy relative to Michael, whose claim was stronger given his lifelong work on the farm. It was also erroneous to assume Michael could pay the legacy without selling estate property. There is no general rule requiring provision of a home for an adult child.
