The plaintiff deliberately failed to serve the statement of claim within the required time, gave no evidence of attempts at service, gave no notice of the application to the defendant, and sought an extension where both the limitation period and time for service had expired and the pleaded defamation claim was conceded to be hopeless because the publications were protected by absolute privilege. Leave to amend and transfer were discretionary, unnecessary, potentially prejudicial to an absent defendant, and the proposed complex claims were not shown to be suitable for the Local Court. The applications were therefore refused and the unserved statement of claim dismissed.
