Cobb v Cobb [2002] NSWSC 946

Cobb v Cobb [2002] NSWSC 946

The will did not make adequate provision for the proper maintenance of the widow, Kay Cobb, as it imposed residence in an unsuitable location with which she has no ties. She is entitled to a legacy to enable her to relocate to a suitable residence and to provide for contingencies, the legacy to be borne equally by assets passing to other beneficiaries. Her debt to a partnership with the Deceased should be forgiven so as not to negate the legacy awarded.
