Section 8(10)(b) of the Safety, Rehabilitation and Compensation Act 1988 (Cth) requires calculation of normal weekly earnings by reference to the job the employee held at the date of injury (or cessation), including the incident allowances attached to that role. The Tribunal erred in conflating the criteria under s 8(10)(a) and s 8(10)(b), and the applicant's entitlement to the Operational Response Group Allowance should have been determined by the actual job held at the date of injury or cessation, regardless of later personal decisions to change jobs.
