An unconditional stay was fair as between the parties because the defendants conceded they lacked assets exceeding the judgment sum and owned no real property, the judgment sum was attracting interest, Mr Simone was able to pay the judgment sum plus interest if the appeal failed, there was common ground that at least some error had been made at first instance, and the defendants' proposed condition of payment of 50% into Court would not advantage them and would prejudice Mr Simone.
