Applying the Tenacity Consulting planning principles, the Court accepted that although some valuable harbour views from 4/75 Fitzwilliam Road would be lost, the loss was adequately compensated by additional harbour and headland views created by the proposed development. The proposal complied with relevant planning controls, including the foreshore building line, LEP 1995 and the DCP, and did not cause unacceptable bulk, scale or harbour-view impacts. Condition C.1(a) was therefore modified rather than retained in its original form, with an additional 1 m setback and a planting height control.
