The proposal complied with relevant planning controls, including the foreshore building line, LEP 1995 and the DCP, and did not cause unacceptable bulk, scale or harbour-view impacts. Condition C.1(a) was therefore modified rather than retained in its original form, with an additional 1 m setback and a planting height control.
