Procedural Posture

Administrative Review of Decision Refusing Application for Taxi Cab Driver Authority / Principal Matter; Review of Internal Review Decision

  1. 1 ['Whether the applicant met the criteria for grant of a taxi-cab driver authority under the Passenger Transport Act 1990 and Passenger Transport Regulation 2007.' 'Whether the applicant was of good repute and in all other respects a fit and proper person to be the driver of a taxi-cab.' 'Whether the applicant had sufficient responsibility and aptitude to drive a taxi-cab.' "Whether allegations about the applicant's behaviour at the Sydney Taxi School should affect his suitability for authorisation."]

Ratio Decidendi

The applicant did not meet the regulatory requirements because he had not successfully completed the taxi-cab driver training course or passed the required examinations or assessments. The Tribunal was also not satisfied that he was a fit and proper person with sufficient responsibility and aptitude to drive a taxi-cab, because it found his total denial of any misconduct at the Sydney Taxi School implausible and considered the reported rude, angry and intolerant behaviour inconsistent with the calm, tolerance and politeness required of a taxi-cab driver.
