In the context of s 24 of the Patents Act 1990 (Cth) and regs 2.2 and 2.3 of the Patents Regulations 1991 (Cth), where the patent in issue is an innovation patent filed as a divisional application, "the filing date of the complete application" in reg 2.2(1A) refers to the complete application for the divisional innovation patent, not the earlier parent standard patent application. The express deeming provisions linking divisional applications to original applications appear in reg 2.3 and reg 3.12, but not in reg 2.2(1A), and there is no basis for giving "the complete application" an ambulatory meaning.
