The original pond proposal was unacceptable because, by reason of its size and location, it would limit opportunities for soft landscaping to the extent that the streetscape would be adversely affected, although the impacts on neighbours would not warrant refusal. The amended design significantly reduced the pond size, increased setbacks and provided an additional 16 square metres of soft landscaped area, and therefore met the objectives of the planning controls and would not adversely affect neighbours.
