Because the power to vary an unentered order must be exercised sparingly in light of finality of litigation, the Court refused to vary the substantive order. However, given the Council's willingness to allow more time and the circumstances advanced, the Court extended the time for compliance to 31 January 2012 and ordered the applicant to pay 50% of the Council's costs.
