Atkins v Leichhardt Council [2012] NSWLEC 1363
The proposed upper level side addition would be clearly visible, would obscure part of the side elevation of the original dwelling, and would detract from the significance of the dwelling, thereby reducing its contribution to the Balmain Heritage Conservation Area. It also failed to satisfy the DCP criteria for varying minimum side setback controls because the street pattern did not generally include upper level additions built to the side boundary and the controls discouraged higher portions of buildings on the boundary. Adequate bathroom and ensuite facilities had already been approved, so the need for the modification did not justify the heritage impact.

Legal Issues
- 1 ['Whether the proposed first floor addition within the side setback would reduce the contribution of the dwelling to the Balmain Heritage Conservation Area and impact on its significance.' 'Whether the proposed upper level addition met the criteria for varying the minimum side setback controls in the Leichhardt Development Control Plan 2000.' 'Whether the need to enlarge the bathroom and ensuite justified the proposed modification given its heritage impact.']
Ratio Decidendi
The proposed upper level side addition would be clearly visible, would obscure part of the side elevation of the original dwelling, and would detract from the significance of the dwelling, thereby reducing its contribution to the Balmain Heritage Conservation Area. It also failed to satisfy the DCP criteria for varying minimum side setback controls because the street pattern did not generally include upper level additions built to the side boundary and the controls discouraged higher portions of buildings on the boundary. Adequate bathroom and ensuite facilities had already been approved, so the need for the modification did not justify the heritage impact.
Court Disposition
The appeal is dismissed and the s 96 modification application is refused.
