Stevens v Leichhardt Council [2015] NSWLEC 1332
The Court accepted the expert agreement and Council submissions that the further amendments to the proposal and the agreed conditions of consent satisfactorily addressed the Council's subdivision pattern, streetscape design, amenity and stormwater contentions. The amended allotments met the 200sqm minimum lot size, the revised roof and dormer design sat comfortably within the streetscape, amenity concerns were addressed, and a 300mm northern setback provided an overland flow path. It was therefore appropriate to grant development consent.
