Although all trees were planted and rose to at least 2.5 metres, only trees 3, 4, 5, 6, 8 and 9 could be construed as forming a hedge. The severe obstruction of the applicant's northern views was principally caused by trees 7 and 11, which did not satisfy s 14A and were outside the Court's Part 2A jurisdiction. The trees that could be treated as a hedge did not themselves severely obstruct the relevant views, or pruning them would not restore the water and coastline views sought because trees 7 and 11 would remain. The jurisdictional requirements for orders were therefore not met.
