The mortgages were not unjust and the transaction was not unconscionable because the loan funds were advanced for the purchase of the property, the property was acquired in the defendant's name, the defendant occupied and used it, the interest rates were not shown to be unfair, and the defendant could not set aside the transaction while retaining the benefit of the land. The defendant had found the property, negotiated the price, understood the transaction, and was mistaken only as to its viability. The plaintiff therefore proved entitlement to possession and the debt.
