The tree was observed to be a healthy mature specimen with no obvious structural defects or instability, very little dead wood and only a relatively small portion of light canopy overhanging the applicant's driveway. Leaf litter and debris did not constitute actionable damage, and the alleged fire risk did not satisfy the jurisdictional tests. Accordingly, the Court had no jurisdiction to make orders for intervention with the tree.
