The Tribunal was not satisfied that Ms TXC was incapable of managing her affairs. It accepted her cogent evidence that she could manage day-to-day affairs with any necessary assistance, understood her assets and expenses, and intended to preserve her inheritance for herself and her child. The Tribunal was also not satisfied that there was a real and present risk of exploitation by Mr QMD or anyone else sufficient to justify a finding of incapability. Because incapability was not established, the financial management application had to be dismissed and the interim financial management order revoked.
