Gobrial v Latuhoi [2009] NSWDC 121
The only injuries causally related to the accident were soft tissue injuries to the plaintiff's chest and abdomen, which resolved quickly. Wrist, neck, and back injuries were not accident-related, but related to pregnancy and work as a nurse. An adjustment disorder with depressed mood was aggravated (but not caused) by the accident and was in partial remission after 2007. The plaintiff's perception of disabling pain was not supported by objective or medical evidence and her capacity for employment and domestic duties was not impaired by the accident after the initial period. Damages are accordingly assessed on the proven sequelae only.
