Brannigan v Westfield & Ors [2007] NSWDC 99
Westfield and P & H owed and breached a duty of care to Mr Brannigan by failing to ensure regular inspection and cleaning of an area with a known risk of oil spillage. The ambiguous cleaning contract and lack of proper inspection systems were causative in the presence of oil which led to Mr Brannigan's injury. Liability was apportioned 75% to Westfield and 25% to P & H, but both were liable in full to the plaintiff.
