Where property disclaimed by a bankruptcy trustee is subject to a mortgage, the court may, under s 133(9) of the Bankruptcy Act 1966 (Cth), vest legal title in the mortgagee on just and equitable terms to allow it to realise its security, with proper accounting and payment of surplus proceeds into Court.
