The Director’s failure to notify NHDS and provide an opportunity to respond with respect to the shift in focus to 56 practitioners in the s 93 referral, and the failure to provide sufficient information about the underlying practitioner conduct and services relied upon in making the referral, constituted a denial of procedural fairness. This was a material jurisdictional error warranting the setting aside of the referral and decision.
