The motion for provision of legal expenses from restrained property was dismissed because the court was satisfied, on the balance of probabilities, that the property from which payment was sought—the bank cheque and company account—was at least in part illegally acquired property, thus precluding relief under s 16A(1)(b) of the Criminal Assets Recovery Act 1990. It was also held that legal expenses incurred on appeal are part of defending a criminal charge, but this did not affect the outcome.
