IDG Communications Pty Ltd and Anor v Niche Media Pty Ltd [1996] FCA 1005
Although the applicants had an arguable case, it was not sufficiently strong to warrant interlocutory relief. Having regard to the specialised readership, the known availability of the American magazine "Publish" in Australia, advance publicity for "Publish Australia", the September appearance of that magazine, and the respondent's prior use for nearly two years of a section entitled "publish", it was unlikely that relevant readers would be misled into thinking that "Publish" was wholly or substantially incorporated in "Desk Top". The balance of convenience also included serious immediate financial hardship to the respondent.
