Ratio Decidendi

The Tribunal accepted the evidence of the two passengers as credible, accepted that a Jack Daniels can was in the centre console beside the driver's seat, found that the Applicant was drinking something while driving and that it was probable he was drinking alcohol, and considered the seriousness of that incident together with the history of complaints. Applying the statutory purpose of taxi-cab driver authorisation and the factors in Saadieh, the Tribunal was not able to assert that the Applicant was a fit and proper person to drive a taxi at that stage and held that suspension was the correct and preferable decision.
