Procedural Posture

Application Pursuant to Section 170 EA of the Workplace Relations Act 1996 Alleging Unlawful Termination / Reasons for Decision and Orders; Application Dismissed

  1. 1 ["Whether the respondent had a valid reason for terminating the applicant's employment based on breach of confidentiality." "Whether the applicant's conduct constituted serious misconduct so that notice of termination was not required under s170DB of the Workplace Relations Act 1996." 'Whether the termination contravened s170DE(1) or s170DB of the Workplace Relations Act 1996.']

Ratio Decidendi

The applicant knowingly disclosed confidential information obtained in the course of her employment in breach of a confidentiality agreement in a workplace where confidentiality was fundamental to the respondent's business. That misconduct gave the respondent a valid reason for termination and was serious misconduct, making it unreasonable to require continued employment during the notice period. There was therefore no contravention of s170DE(1) or s170DB of the Workplace Relations Act 1996.

Court Disposition

Application dismissed.
