Because the plaintiff had an arguable equity arising from the agreement noted by White J and the pending enforcement proceedings could establish that AAP was not entitled to indemnity from superannuation trust assets for costs incurred in defending those proceedings, Ms Bechara's judgment could not be enforced against assets held by AAP as trustee. However, restraining Westpac from complying with the District Court garnishee order would risk placing Westpac in contempt of one court or the other, so the appropriate alternative was to require Ms Bechara to pay into court any money received under the garnishee order.
