Nominal Defendant v Bagots Executor & Trustee Co Ltd [1971] HCA 42
Section 32(1) of the Motor Vehicles (Third Party Insurance) Act (NSW) authorizes recovery of damages paid by the nominal defendant from the estate of a deceased person who was the owner or driver of the motor vehicle at the time of the occurrence, and does not require the person to be alive at the time of payment.
