Based on consistent and uncontradicted affidavit evidence, the court was satisfied both that Alice Margaret Campbell knew and approved the gift to the plaintiff and that the gift was made freely and voluntarily in accordance with s.13(2)(c) of the Wills, Probate and Administration Act 1898. The statutory presumption of invalidity was overcome, rendering the gift valid. No special case was established to depart from the default costs rule and, subject to the defendant’s indemnity costs from the plaintiff’s share, costs were otherwise to lie where they fell.
