The documents were internal memoranda, drafts and a final Cabinet submission, forwarding memoranda, and a record of a Cabinet decision that did not identify Ministers' views or any debate. The respondent's class-based concern about inhibiting candour carried little weight on the nature and contents of these documents, while the applicant's improper purpose allegation was serious and refusal of production would seriously hamper its ability to prove actions, motives and reasons of those acting for the Northern Territory.
