The directors did not call the requisitioned general meeting within the 21 day period because, although they resolved to hold a meeting, notified the ASX, and authorised finalisation and dispatch of notices, no notices were sent to members by 17 April 2009. Sending notice to members was essential to calling the meeting. The members' power under s 249E(1) was therefore enlivened, and the defendants validly called the meeting for 28 May 2009.
