There was no real ground for concluding that the judge's prior public comments indicated an adverse view of the applicant or its actions. The judge's comments were made some time ago in a public forum unrelated to the proceedings, referred to general matters, and did not relate directly to the applicant or the issues in the case. Therefore, a fair-minded lay observer would not reasonably apprehend that the judge might not bring an impartial mind to the resolution of the issues. Even if the comments were interpreted as indicating an adverse view, there was no logical connection between that view and the legal questions to be determined.

There was no real ground for concluding that the judge's prior public comments indicated an adverse view of the applicant or its actions.
