BAS should pay OBL's costs of and incidental to the proceeding because OBL succeeded on its primary claim that BAS placed the Somerton Securities in breach of ASX Listing Rule 7.1 and its Constitution and obtained appropriate relief. Although OBL failed on other substantive claims and in defending the cross-claim, the additional cost, time and complexity of those issues were not large, the hearing took one day, relevant evidence overlapped with the primary claim, and apportionment of costs by issue was not justified. BAS should also pay the costs of the interlocutory application heard on 16 August 2012 because the application would have been unnecessary if BAS had promptly informed OBL...
