The appeal was dismissed because the alternative cause of action and causal thesis concerning the respondent’s alleged failure to act on the 6 June notification were not pleaded or particularised. The trial was conducted and managed based on the issues actually pleaded and contained in expert reports. As such, the primary judge's evidentiary ruling was correct, and even if the alternative case had been permitted, the result on causation would have been the same. It is contrary to fundamental principles of procedural fairness to allow an alternative unpleaded or unparticularised claim to succeed on appeal.
