Because the applicant was an owner entitled to nominate herself for election to the executive committee and was denied that statutory right, she was adversely affected by the non-compliance with the Strata Schemes Management Act 1996. Accordingly, the Adjudicator erred in finding that no person was adversely affected and could not refuse an order under s 153(2). The AGM notice also did not properly include a motion to decide the number of executive committee members, and no such resolution was passed, so the appointment or election of two persons to the executive committee at the 25 June 2014 AGM was invalid. The appeal was otherwise dismissed because orders concerning the 23 March 2015...
