The Court had power to determine the development application because the 2002 consent for use of the existing warehouse building for warehousing/storage and distribution of alcoholic goods was a lawful existing use, and deleting the limitation to alcoholic goods to allow storage and distribution of other goods was an enlargement or expansion of that warehouse use, not a change of use. On the merits, the planners agreed that refusal was not warranted if appropriate conditions were imposed, and conditions regulating hours, access, vehicle size, noise and prohibited goods would protect amenity while allowing the existing use to continue.
