The conditional certificates issued by the Superintendent did not satisfy the contract definition of certificate of practical completion. The Superintendent failed to act reasonably and in good faith as required. The Court, under the contract, determined practical completion was reached on 25 September 2017. Liquidated damages are calculated per contract for delay, and common law damages are excluded by the contract regime, except for defects not apparent or not disclosed upon reasonable inspection at the final certificate date.
