The representations made in the web advertisement, brochure and by the agent were not conduct by Mr Williams in trade or commerce. The vendors had lived in the property as their home for a significant period, and neither prior renovation with an intention to sell at a profit, use of an estate agent, online advertising, nor Ms Dandris's intended interior design business converted the sale of the residence into conduct in trade or commerce by Mr Williams. Because the only basis for judgment against Mr Williams was liability under ss 18 or 30 of the Australian Consumer Law, no liability arose and the appeal was allowed.
