Given that the Certificate of Title was in court's custody after the first defendant failed to deliver it despite orders, and no real prospect was shown for setting aside the original judgment or bankruptcy order, the interests of justice required that the Certificate be delivered to the plaintiffs' solicitor for the sole purpose of registering it with the Registrar-General, to allow sale pursuant to statutory trust for sale.
