Wilson v Gilles [2020] NSWSC 657
The husband and wife instructed Giles Payne & Co to hold the net proceeds of sale in trust on behalf of both of them until they agreed what to do with the money. Because the funds were received on behalf of more than one person, s 138(1) of the Legal Profession Uniform Law (NSW), read with s 8(b) of the Interpretation Act 1987 (NSW), required directions from both clients before disbursement. The husband had no authority to direct on the wife's behalf, and the Court was not prepared on the limited evidence to order payment of his claimed 75% share contrary to the absence of agreement, particularly given the sale occurred in the context of resolving matrimonial property claims.
