Procedural Posture

Application for Review Under S 476 of the Migration Act (1958) (cth) of a Refugee Review Tribunal Decision Affirming Refusal of a Protection Visa / Reasons for Judgment in the Federal Court; Application Dismissed

  1. 1 ['Whether the Refugee Review Tribunal erred in law by failing to consider whether the applicant was persecuted by reason of race or membership of a particular social group, namely young Tamil males or fishermen subjected to threats and extortion by Tamil groups' 'Whether the Refugee Review Tribunal erred in law by failing to make findings on whether mistreatment by Tamil groups was persecutory' 'Whether the Refugee Review Tribunal made inconsistent findings about whether Tamils in Sri Lanka are targeted by government authorities and misunderstood what constitutes a Convention reason for persecution' 'Whether legitimate security measures were being abused so as to become systematically persecutory and whether government action ruled out risk of future persecution' 'Whether the Refugee Review Tribunal failed to consider whether the applicant faced a real chance of future persecution despite findings that he had not suffered past persecution to the extent claimed' "Whether the Refugee Review Tribunal assessed the applicant's fear as at the date of its decision" 'Whether alleged procedural breaches under s 430 of the Act were made out']

Ratio Decidendi

The application failed because the Refugee Review Tribunal made findings open on the evidence that any demands or harassment by Tamil groups were for money, services or recruitment, and that any attention by Sri Lankan security forces was for security reasons rather than because of the applicant's race or membership of a particular social group. Without a Convention reason, any mistreatment could not establish refugee status. The asserted inconsistencies and failures to consider future risk, abuse of security measures, timing of assessment, and s 430 procedural errors were not made out.
